Before deploying any infrastructure or creating an account with iDatam, it is mandatory that you thoroughly review and understand our Terms of Service (TOS).
The following terms and conditions serve as a binding agreement between you (the "Subscriber" or "Client") and iDatam (referenced herein as the "Company," operating via www.idatam.com and its subsidiaries). As a legally recognized corporate entity, iDatam enforces these rules for all users interacting with our platform, whether you are utilizing paid infrastructure or free resources. By provisioning our services, you expressly consent to the stipulations outlined below.
1. Client Age Requirements and Legal Capacity
1.1 Minimum Age: To provision services or finalize any orders through the iDatam system, you must be a minimum of 18 years of age and possess the legal authority to enter into binding contracts.
1.2 Underage Clients: If you are under the age of 18, you must immediately notify our team and cease using our services. Continued use of the iDatam platform by minors without authorization is strictly prohibited.
1.3 Parental Consent: Any user under 18 years old must secure explicit, verifiable permission from a parent or legal guardian to access our website or procure services. iDatam entirely disclaims any legal or financial liability arising from a user misrepresenting their actual age.
2. Platform Access and Usage Restrictions
2.1 Information Accuracy: Access to the iDatam control panels is contingent upon the submission of accurate, truthful, and comprehensive personal data, which we store securely. Should we detect fraudulent, omitted, or falsified information, we reserve the right to deny service. Furthermore, suspected fraud will result in immediate account termination without eligibility for a refund.
2.2 Licensing Scope: By agreeing to this TOS, you are granted a non-transferable, non-exclusive, and limited license to use our infrastructure for lawful private or commercial endeavors. You bear full responsibility for securing your services against unauthorized access or abuse. iDatam reserves the right to enforce network security protocols and bandwidth limitations. Any unlawful use of our network instantly revokes this license and exposes the violator to maximum legal prosecution.
3. Identity Verification & KYC Enforcement
To sustain a highly secure and compliant global network, iDatam requires mandatory Know Your Customer (KYC) verification.
3.1 Mandatory Data: You are required to submit genuine personal details, specifically your Full Name, Email Address, Phone Number, Physical Address, Country, and Postal Code.
3.2 Verification Protocol: Orders masked behind Proxies, VPNs, or Tor networks will trigger automatic rejection. If our system flags your details as inaccurate, you will receive exactly one opportunity to rectify the issue by submitting a valid, government-issued photo ID alongside biometric confirmation.
3.3 KYC Failure & Refunds: Should you fail the KYC process, refunds are exclusively permitted for transactions processed via American Express (Amex), Mastercard, and Visa. Payments executed via Cryptocurrency, alternative, or non-reversible gateways are completely non-refundable. Submitting deliberately fabricated data or leaving KYC fields blank will result in a permanent network ban. All funds in a banned account will be frozen indefinitely, with zero refund exceptions.
3.4 Data Privacy: iDatam treats your privacy with the utmost seriousness. Your personal information is strictly confidential and will never be shared, leaked, or sold to unauthorized third parties.
4. Financial Policies: Billing, Subscriptions, and Refunds
4.1 Invoicing Fundamentals: Service deployment begins only after total payment has cleared. Invoices are generated and sent 14 days prior to your billing cycle's due date. Timely payment is the sole responsibility of the Subscriber.
4.2 Accepted Payments & Overdue Accounts: iDatam accepts Credit Cards, Wire Transfers, Cryptocurrency (USDT/Bitcoin), and other verified gateways. If an invoice remains unpaid for more than 24 hours past the deadline, iDatam holds the right to suspend or entirely terminate your active services.
4.3 Refund Limitations: All sales are final. iDatam does not issue refunds unless a verifiable billing error has occurred or the situation qualifies under our Service Level Agreement (SLA, Section 11).
4.4 Automated Renewals: Credit Card transactions automatically enroll you in recurring subscriptions. Your card will be charged on each subsequent due date. Subscription renewals are non-refundable. To prevent future charges, you must submit a cancellation request via the iDatam Customer Portal or open a support ticket before the renewal triggers.
4.5 Deployment Fees: Standard setup fees for dedicated bare-metal servers are waived by default, barring any highly customized third-party hardware/software requests.
5. Infrastructure and Services Portfolio
Bare Metal & Dedicated Servers: Enterprise-grade server deployments featuring customizable storage, RAM, and processing capabilities.
Colocation: End-to-end facility colocation, including IP provisioning, diverse uplinks, cabinet space, and redundant power.
DDoS Protection: Advanced Layer 1 through Layer 6 ingress filtering to mitigate distributed denial-of-service threats.
IP Transit: High-capacity global routing options tailored specifically for our colocation clients.
6. Intellectual Property & Copyright
All content, design, and textual materials on the iDatam website are our exclusive intellectual property. We strictly prohibit unauthorized copying, modification, or distribution of our proprietary assets without prior written consent. Utilizing our network grants you zero ownership over our intellectual property.
7. Acceptable Use Policy (AUP) & Prohibited Content
iDatam operates under a strict Acceptable Use Policy to protect our global network ecosystem. Leveraging our infrastructure to host, distribute, or facilitate any of the following is expressly forbidden:
Under no circumstances may iDatam servers be used for unlawful endeavors. We proactively monitor our network for abuse. If your environment is flagged for Dark Web marketplaces, Ransomware distribution, Malicious Tor Exits, CSAM, Warez, or Phishing, your server will be immediately seized and permanently wiped without notice or refund.
iDatam actively cooperates with the authorities. In the event of severe AUP violations, your complete KYC profile, connection logs, and IP history will be unconditionally surrendered to local law enforcement and international cybercrime divisions for prosecution.
8. Delinquent Accounts & Service Suspension
8.1 Colocation Equipment Forfeiture: Should a colocation invoice remain unpaid for over 30 days, iDatam reserves the legal right to seize ownership of the racked hardware as collateral.
8.2 Breach of Contract: Violating any clause in this TOS or failing to pay invoices will trigger immediate service suspension. Following termination, iDatam retains the right to securely format and destroy all data remaining on the hardware.
9. Provisioning and Upgrade Policies
9.1 Hardware Upgrades: Unless an immediate upgrade invoice is paid in full, requested service upgrades will be applied at the genesis of your next billing cycle.
9.2 Deployment Timeframes: Standard server deployments are finalized within 24 hours. Complex bare-metal configurations may require additional time depending on current hardware stock.
10. Cancellation Procedures
To terminate your service, you must file a verified cancellation ticket through the iDatam Customer Portal no later than 24 hours before your next invoice is due. Mid-cycle cancellations do not qualify for pro-rated refunds, and you remain financially liable for all charges accrued prior to the cancellation date.
11. SLA & Satisfaction
iDatam pledges a 99.99% network uptime guarantee. If internal network failures cause us to breach this threshold, subscribers may claim SLA service credits. Please note that initial setup fees are strictly non-refundable. For all technical disruptions, clients are required to immediately open a support ticket for mitigation.
12. Limitation of Liability & Data Integrity
12.1 Backup Responsibility: Unless you have explicitly purchased a managed backup package, iDatam does not automate backups of your server. The Subscriber carries 100% of the responsibility for maintaining secure, off-site data backups.
12.2 Total Liability Waiver: iDatam, its executives, and its personnel shall not be held liable under any legal theory for indirect business damages, loss of revenue, security compromises, hardware degradation/failure, or catastrophic data loss stemming from the use—or inability to use—our infrastructure.
13. Force Majeure
iDatam cannot be held legally or financially responsible for service interruptions, delays, or failures caused by uncontrollable global events. This includes, but is not limited to, government mandates, acts of terrorism, warfare, natural disasters, catastrophic global power failures, or systemic global internet backbone outages.
14. Policy Amendments
iDatam retains the absolute right to modify, add, or remove portions of this Terms of Service agreement at any time. Updates take immediate effect upon being published to www.idatam.com. By continuing to utilize our network after a modification is posted, you signal your explicit consent to the new terms. If you reject the updated terms, you must cease using our services and submit a cancellation ticket immediately.
15. Jurisdiction and Governing Law
The stipulations within this Terms of Service document are governed by and interpreted in accordance with the laws of the United States. Any legal disputes or claims associated with these terms will be resolved exclusively within the state and federal courts located in the United States.
